These Terms & Conditions (“Terms“) govern your access to and use of the website kitchenops.tech (the “Website“) and the KitchenOps restaurant management platform, including its POS, Kitchen Display System, Delivery, Orders, Tables & Dining, Reservations, Waitlist, Billing & GST, Customers (CRM), Inventory, Promotions, Users & Roles, Menu Management, and Reports & Analytics modules (collectively, the “Services“), provided by Saazify (“KitchenOps“, “Company“, “we“, “us“, “our“).

By registering for, accessing, or using the Services, you (“you“, “User“, “Account Holder“) agree to be bound by these Terms and our Privacy Policy and Cancellation & Refund Policy. If you are using the Services on behalf of a business, you represent that you have the authority to bind that business to these Terms.

1. Eligibility and Account Registration

  • You must be at least 18 years old and legally capable of entering into a binding contract to use the Services.
  • You agree to provide accurate, current, and complete information during registration and to keep it updated.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@kitchenops.tech if you suspect unauthorized use of your account.
  • Account Holders are responsible for the actions of staff users they add to their account and for setting appropriate roles and permissions under the Users & Roles module.

2. Description of Services

KitchenOps is a cloud-based, subscription software-as-a-service platform for restaurants, cloud kitchens, cafes, QSRs, bakeries, bars & breweries, food courts, ice cream & dessert shops, pizzerias, food trucks, catering businesses, and large restaurant chains. Features and availability may vary depending on your subscription plan and are subject to change, addition, or removal at our discretion, with reasonable notice for material reductions in functionality on paid plans.

3. Plans, Free Trial, and Fees

  • KitchenOps offers Basic and Professional plans that may be used free of charge with the feature scope described on our Pricing page, and an Enterprise plan available on request with custom pricing and features.
  • Where offered, a free trial (currently up to 90 days) allows access to paid features for a limited period. We may modify the length or availability of any free trial at our discretion.
  • Paid subscription fees, billing cycles, and applicable taxes (including GST) will be presented at the time of purchase or upgrade. Fees are billed in advance and, unless stated otherwise, do not include third-party charges (e.g., payment gateway fees, SMS/WhatsApp costs, or aggregator commissions).
  • We may change our pricing or plans from time to time. Where you are on a paid plan, we will provide reasonable advance notice of price changes that affect your subscription before they take effect at your next renewal.
  • Refunds, if any, are governed by our separate [Cancellation & Refund Policy].

4. Your Data and Content

  • All data you input into the Services — including menu items, orders, billing records, inventory data, customer/CRM records, and reports (“Customer Data”) — remains your property.
  • You grant KitchenOps a limited, non-exclusive license to host, process, and display Customer Data solely for the purpose of providing and improving the Services.
  • You are solely responsible for the accuracy, legality, and appropriateness of the Customer Data you input, including obtaining any consents required from your own staff and customers to process their personal data through the Services.
  • You may export or request a copy of your Customer Data at any time during an active subscription, subject to reasonable technical limitations.

5. Third-Party Integrations

The Services may integrate with third-party platforms such as Zomato, Swiggy, Razorpay, Tally, and WhatsApp for Business. Such integrations depend on the availability, terms, and APIs of those third parties and are provided “as available.” We are not responsible for outages, changes, or errors originating from third-party platforms. Some integrations described on the Website may be under active development and subject to change before general availability.

6. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
  • Attempt to gain unauthorized access to the Services, other accounts, or our systems;
  • Reverse-engineer, decompile, or attempt to extract the source code of the Services, except as permitted by law;
  • Resell, sublicense, or provide the Services to third parties as a standalone product without our written consent;
  • Upload malicious code, or interfere with or disrupt the integrity or performance of the Services;
  • Use the Services to store or transmit content that is unlawful, defamatory, or infringes the rights of others.

We reserve the right to suspend or terminate accounts that violate this section.

7. Intellectual Property

The Services, including all software, design, text, graphics, logos, and trademarks (including “KitchenOps” and associated branding), are the property of KitchenOps or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent.

8. Service Availability

We aim to keep the Services available and performant but do not guarantee uninterrupted, error-free, or continuous access. The Services may be temporarily unavailable due to maintenance, updates, third-party outages, or circumstances beyond our reasonable control. We are not liable for losses arising from such interruptions, except as required by applicable law.

9. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, KitchenOps disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet all your requirements or be free from errors.

10. Limitation of Liability

To the maximum extent permitted by applicable law, KitchenOps and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Services. Our total aggregate liability arising out of or relating to these Terms or the Services shall not exceed the amount you paid to KitchenOps for the Services in the twelve (12) months preceding the claim, except where such limitation is not permitted by law.

11. Indemnification

You agree to indemnify and hold harmless KitchenOps, its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms, or your violation of any applicable law or third-party right, including in relation to Customer Data you upload.

12. Suspension and Termination

  • You may cancel your account at any time in accordance with our [Cancellation & Refund Policy].
  • We may suspend or terminate your access to the Services, with or without notice, if you breach these Terms, engage in fraudulent or unlawful activity, fail to pay applicable fees, or if required by law.
  • Upon termination, your right to use the Services ceases immediately. We may retain Customer Data for a limited period post-termination as described in our Privacy Policy, after which it may be deleted.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or a notice on the Website. Continued use of the Services after such changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts at Ahmedabad, Gujarat, India.
